1. Chief Deputy Prosecuting Attorney

The Chief Deputy Prosecuting Attorney is the #2 position in the Washtenaw County Prosecutor’s Office, and will report directly to the elected Prosecuting Attorney. Together with the Prosecuting Attorney, the Chief Deputy Prosecuting Attorney is responsible for the overall direction and management of department administration and operations. 

Duties of the Chief Deputy Prosecuting Attorney may include, but are not limited to:

  • Planning, directing, implementing, and achieving strategic goals and objectives related to the Prosecuting Attorney’s mission of ensuring fairness and equity in prosecution, prioritizing rehabilitation and treatment, providing high-quality prosecution and victim services, and ensuring public safety.
  • Managing and directing the activities of assigned staff; coordinating, prioritizing and assigning tasks and projects; tracking and reviewing work progress and activities; directing the recruitment and selection of staff; undertaking disciplinary action as required; conducting performance evaluations; and ensuring appropriate scheduling of staff to ensure proper operational coverage. 
  • Managing subordinate managerial and/or supervisory attorney staff.
  • Assisting in the development and implementation of written policies, in accordance with the direction of the Prosecuting Attorney.
  • Working with community partners, law enforcement, and the courts, spearheading the development of new diversion and deflection programs, as well as new specialized units within the Prosecuting Attorney’s Office.
  • Recommending selection of staff; training staff and providing for their professional development; administering discipline as required.
  • Assisting in the organization of the Office of the Prosecuting Attorney. 
  • Assisting in the development and implementation of goals, objectives, procedures and work standards for the Office of the Prosecuting Attorney; assisting in the preparation and administration of the Office’s budget. 
  • Evaluating requests for the issuance of a criminal complaint; analyzing evidence presented and determining whether or not complaint can be justified or whether additional evidence is needed; authorizing criminal complaints. 
  • Reviewing law enforcement reports to determine charges to be filed; preparing complaints, affidavits, warrants, and summons; conferring with law enforcement officers and witnesses; negotiating with defense attorneys; preparing motions and other pleadings for court; preparing cases and witnesses for court; appearing in court; conducting hearings and trials; advising police and probation officers. 
  • Interpreting and applying laws, court decisions and other legal authorities for use in preparation of cases, opinions and briefs. 
  • Preparing pleadings and other legal documents in connection with trials, hearings and other legal proceedings. 
  • Preparing written legal reports, opinions, briefs, and appeals. 
  • Advising law enforcement officers and others on criminal proceedings and procedures. 
  • Contributing to the overall quality of service by developing and coordinating work teams and by reviewing, recommending and implementing improved policies and procedures.
  • Serving as the Prosecuting Attorney’s designee or representative where requested, including on task forces, at community meetings, and before legislative and executive bodies. 
  • Acting on behalf of the Prosecuting Attorney and in the Prosecuting Attorney’s absence; representing the Office of the Prosecuting Attorney in high-level County meetings.
  • Meetings with employees, legislators, and the media.
  • Analyzing the impact of existing and proposed legislation and providing recommendations.
  • Performing such other duties as the Prosecuting Attorney may deem necessary. 

Qualified candidates will have a Juris Doctorate from an accredited law school, and be admitted to the State Bar of Michigan or be able to obtain Michigan Bar membership within six months. Qualified candidates will also have significant criminal-law experience as an attorney. 2. Supervising Prosecuting Attorney

A Supervising Prosecuting Attorney is a managerial position within the Office of the Prosecuting Attorney. Duties of a Supervising Prosecuting Attorney may include, but are not limited to:

3. Assistant Prosecuting Attorney

An Assistant Prosecuting Attorney is responsible for litigating cases on behalf of the People of the State of Michigan. Duties of an Assistant Prosecuting Attorney may include, but are not limited to:

  • Litigation and legal research; drafting legal documents; and interpreting laws, rules, and regulations.
  • Prosecuting misdemeanor and/or felony cases in an assigned court.
  • Participating as the Prosecutor’s Office representative in problem-solving courts, and in problem-solving court team meetings.
  • Drafting, filing and responding to necessary motions, briefs or other legal documents for trials and/or hearings.
  • Representing the People in trials and hearings by: conducting jury selection, presenting opening statements, conducting direct and cross-examinations of witnesses, and presenting closing arguments.
  • Explaining legal process to potential witnesses, preparing witnesses for court testimony, and working with victims’ advocates to ensure victims/families are kept informed on status of cases.
  • Gathering, preparing, and presenting evidence, exhibits and related material for trials or hearings.
  • Participating in settlement or plea-bargain negotiations.
  • Performing case evaluation, preparation and management; representing the People in pre-trial and evidentiary hearings and jury/court trials; and ensuring effective communication with defense attorneys, court personnel, victims and family members, witnesses and other interested parties.
